Our members have asked us frequently over the years about Visas and how to obtain them. We honestly had no idea so we decided to do a little research and report our findings. Though there’s a plethora of employees in the United States, at times you as an employer may elect to hire a foreign national for employment. Though the process has been streamlined somewhat, there’s a few major things that must be understood when importing skilled labor for employment from another country; namely the H1B Visa at the hurdles that come with it.
The H1B visa is the legal visa granted for foreign nationals employed in the United States who have obtained the equivalent of a bachelor’s degree or higher in their field of expertise. For example, a worker imported from Canada who has merely completed their version of our K-12 education would not be covered under this visa.
The process of applying for the visa comes with tricks beyond the simple problem of filling out a few government forms, sending a check or credit card payment and waiting for your laminated strip of paper in the mail.
Like many visas, the H1B comes with a hard cap of issues documents, the H1B specifically being 65,000 issued visas per year, with 20,000 individuals exempted due to holding a higher equivalent degree (masters or PhD). Furthermore, while an H1B visa holder can come to the US to work, there’s a few caveats employers and potential employees have to consider.
If an imported worker is given a visa, they are permitted to bring family members and dependents with them. Employers offering to cover relocation expenses must take into consideration that if a worker is bringing family members, the costs may skyrocket.
